How long does it take to enforce a judgment?

The timeline to enforce a judgment depends on the size of the judgment, as well as the debtor’s net worth and asset-protection schemes. Many debtors are more than capable of paying, but instead choose to “bury” their assets through fraudulent transfers and transactions. Such acts only delay the inevitable. Other debtors are reasonable, responding to enforcement with good-faith offers for settlement. In short, the process can take anywhere from a few months to several years.

Can one enforce a judgment against out-of-state assets?

Yes. The process requires “domesticating” the judgment in the state where the assets are located. Once domesticated, the judgment can be enforced against the defendant’s assets in that state.
