Judgment Enforcement
In California, 98% of civil lawsuits settle before trial. The remaining cases often result in payment on a judgment after trial. But what happens when a case does not settle, and the losing party refuses to pay?
A rude awakening, to say the least.
Parties who bear the expense and stress of protracted litigation expect to be paid upon prevailing. Unfortunately, that is only where the fun begins for nefarious defendants, who not only ignore their debt obligations, but actively conceal and siphon their assets to obstruct collection. The unwary judgment creditor is left helpless, with a hard-fought judgment seemingly worth less than the paper it's on.

By the same token, the firm aggressively defends judgments on appeal by adverse parties, especially where such appeals are utilized to delay, obstruct or harass the prevailing party.
The firm's founder has handled appeals from the outset of his career, and worked on numerous cases resulting in published opinions. The most notable opinion, Butler America, LLC v. Aviation Assurance Company, LLC (2020) 55 Cal. App. 5th 136, has become a staple in commercial litigation and the post-judgment arena, with recent citations by the United States Bankruptcy Appellate Panel for the Ninth Circuit in Milestone Fin., LLC v. Moon (In re Moon), 648 B.R. 73 (B.A.P. 9th Cir. 2023), the First District Court of Appeal in JPV I L.P. v. Koetting (2023) 88 Cal. App. 5th 17, and the Second District Court of Appeal in Blizzard Energy, Inc. v. Schaefers (2021) 71 Cal. App. 5th 832.
Other noteworthy opinions include St. Monica Dev. v. Gabrielino-Tongva Tribe, 2023 WL 4397158, in which Armen Manasserian represented the aboriginal tribe of the Los Angeles Basin in defending a judgment of over $26 million for legal malpractice and fraud; as well as Mitchell v. Buehler Family Bakersfield, LLC, 2019 WL 5799979, in dismissing an appeal on account of appellants' post-judgment obstruction, and thus successfully defending a judgment of over $7 million for oil theft.
